I was looking over the opinions of the various courts in that case, Chewie. For my part, I commend you to check out Justices Souter's and Breyer's two dissenting opinions.
Here's why we're headed for the same catastrophe in this country again: bipolarization of our nation. As noted by the SCOTUS, in any given election in this nation, there is a 2% margin of error -- made up mostly of votes that don't get counted due to technical defects. That's a problem because in a recount (such as Florida's), you are by definition already within a window smaller than that. FL's law, for instance, requires a recount at 0.5% margin of victory.
The problem is simply that the margin of error is still greater than the likely margin of victory. A real damn dilemma.
Of course, we could scrap the party system, or establish real 3rd parties to try to break this gridlock.
