True, Skunk. But also, neither should a government seek to crimialize the actions of everyday citizens going about their daily lives. The Border Patrols error on the side of grand stupidity was failing the needs of the town.
Yes he broke the law, but the government placed him in a postion to do so. He did not go out of his way to circumvent the law. The grand stupidity I am refering to is the government not recognizing the hole in the application of it's policy that turned an average citizen into a border breaker. The stupidity to fail to recognize the needs of the town. Now he did break the law, but the justice system has the option on how to apply it. In this case, the law isn't the problem, but lack of governmental service that put the average citizen in conflict with the law.
